Facebook Fugitive Taunts Cops with Pictures and Status Updates “Remember how, in Catch Me If You Can , fugitive Leonardo DiCaprio kept calling Detective Tom Hanks to taunt him? Here is a convicted burglar doing the same thing, in real time on Facebook. Should we celebrate or fear him?”

I have mixed feelings, I’m wondering what he was locked up for in the first place. Since NY laws are considerably different than TN laws I can’t even begin to speculate. Was it a violent offense? Sexual? Drugs? Theft? Dishonesty?

Sentencing guidelines are a bit mind boggling and eye-opening at the same time. The punishment for an E-felony offense of Possessing Drugs with the intent to sell/deliver for a first time offender is 1 to 2 years to be served at 30%. That means on paper it will say 1 to 2 years, which sounds pretty scary, but with good behavior, the defendant actually can out in on parole for the remainder of the sentence after serving about 4 to 8 months. And since most cases can take that long to get settled, most of the time is already served or the atty can get a time-served offer, even if the defendant isn’t in custody, since being out on bond is essentially a probation. That’s a wide gap between legislative intent and application. Sent via BlackBerry by AT&T
